Last Ticket for you Sàrl (hereinafter referred to as Last Ticket For You) is a company for the promotion of events, creation and promotional offers aimed at all audiences and all types of offers on Swiss territory. Thereafter Last Ticket For You will be able to publish offers in other countries.

 

Last Ticket For You is a platform for the referencing of events and a ticketing service.

The present terms and conditions were put online on 04 January 2021.

 

It is specified beforehand that these general terms and conditions of sale exclusively govern ticket sales on this site (hereinafter, the "Site"), to the exclusion of any other similar site.

 

Last Ticket for You acts as an intermediary, in its own name but on behalf of the organizer or the artist whose tickets are sold on the Site.

 

Consequently, the present general conditions of sale concern only the acts of sale of ticketing and in no case the show or the event itself.

 

The use of the Site, of any functionality of the Site implies the express, prior, full and entire acceptance by the Customer of the present General Conditions of Sale. The non-respect by the Customer of the obligations subscribed under the terms of the present General Conditions of Sale, and in particular in the event of fraud or any attempt at fraud, resale of tickets and any incident of payment of the price of an order, can involve the suspension of the access to the service, or even the blocking of his customer account according to the degree of gravity of the actions in question, without prejudice to any damages that the company Last Ticket For You could request. Consequently, Last Ticket For You reserves the right to refuse any order from a customer with whom such a dispute exists.

Art.1 - Price

 

1.1 Ticket prices are in CHF and include all taxes and fees. 

 

1.2 The tickets remain the property of the organizer of the event until the total and definitive collection of the price by Last Ticket For You, in its name and on behalf of the organizer. The price offered is the exclusive responsibility of the organizer of the event; Last Ticket For You does not in any way determine the price of the tickets. This is the sole responsibility of the organizer.

 

Art.2 - Number of seats

 

The total number of places in accumulated reservations per person cannot exceed the number set by the organizer. The same person cannot circumvent this rule by making several purchases spaced out in time.

 

Art.3 - Availability and seating plan

 

The customer is informed, in real time, when placing his order, of the availability of the desired seats.

 

In the event of unavailability of all or part of the seats desired by the customer in the category indicated, he will be offered available seats in another category.

 

If the number of seats requested is greater than the number of seats available in the chosen category or in another proposed category, it is possible that non-contiguous seats may be allocated to the customer.

 

Art.4 - Payment

 

4.1 General Provisions

 

All orders, regardless of their place of issue, are payable in CHF.

 

The validation of the order implies the obligation for the customer to pay the price indicated by the total amount of the basket.

 

The payment of tickets by the customer on the site is made exclusively by the following means of payment and defined at the time of purchase: VISA / EUROCARD / MASTERCARD, POSTFINANCE CARD, TWINT.

 

The customer's bank account will be debited for the amount of the order as soon as the transaction is finally validated.

 

A proof of payment will be automatically available to the customer, at the end of the transaction, on the confirmation page of the order but also on the account, and accessible through the login / password, which will have been assigned and defined during the purchase

 

4.2 Payment security

 

Electronic payments made as part of the transactions carried out on the Site are secured by using the SSL (Secure Sockets Layer) encryption process.

 

The customer guarantees to Last Ticket For You that he is fully authorized to use the payment card for the payment of his order and that the payment card provided will legally give access to sufficient funds to cover all the costs resulting from his purchase on the Site and acknowledges that he alone bears the responsibility.

 

In case of failure to pay, the customer is duly informed of Lasticket's right to cancel the sale of the ticket(s) without prior notice or information. The customer will, if necessary, be reimbursed for any sums already paid and will not be able to claim any compensation whatsoever because of this cancellation.

 

Art. 5 - Gift voucher / Discount code / Credit note

 

It is expressly stated that these provisions apply only in the event that the Site provides, at the discretion of the organizer, on a one-off or permanent basis, the use of one or more discount vouchers. The eligibility of one or more discount vouchers on the Site will be characterized by the presence of the field provided for their entry at the "Payment" stage.

 

5.1 Gift voucher

 

A gift voucher is a product that can be offered for sale and that allows its beneficiary, within the limit of its face value, to purchase tickets for one or more events on the Site.

 

Once the payment has been validated, the purchaser will receive the gift voucher in the form of an electronic ticket on his/her e-mail address.

 

A gift voucher is valid for one year from the date of purchase.

 

If the face value of the gift voucher is higher than the face value of the ticket(s) chosen, the customer may obtain a discount code for the difference by formulating his request by e-mail to Customer Service within six months of the date of purchase.

 

It is specified that any discount code issued pursuant to this article may in turn give rise to the issue of one or more other discount code(s) if its face value is greater than the ticket(s) chosen, until the entire balance is used, provided that the request is made within six months and subject to the expiry date of the validity of the gift voucher initially acquired.

5.2 Discount code

 

Discount codes may, at any time and at the discretion of the organizer and/or Last Ticket For You, be issued, offered, or to be won, to one or more individual clients or to all clients of the organizer and/or Last Ticket For You, for a particular Event, or a group of Events.

 

Any other particular conditions of use will be specified at the time of the code's issue.

 

5.3 Assets

 

The credit note is a commercial document that can be issued by the customer service of Last Ticket For You at its discretion and/or at the request of the organizer, which is valid as a means of payment for a purchase on the Site. Any particular conditions of use, such as the period of validity, will be specified at the time of issue.

 

5.4 Common terms and conditions of use

 

The terms and conditions of use appearing in the present article apply indifferently to the discount code(s) and credit issued by Last Ticket For You (hereinafter referred to together as "the discount code(s)"), except for special conditions provided for by the latter or by the present article.

 

In order to use a coupon, the Customer must follow the normal ticket purchase process.

 

At the "Payment" stage, before entering the other means of payment, the customer must enter his or her discount voucher in the field provided for this purpose ("To apply your discount to the basket, insert your discount code in the following field"). This process must be repeated as many times as the customer wishes to use one or more discount vouchers. 

 

It is up to the customer to check that the discount has been taken into account on the amount of his or her basket before validating payment or, if applicable, paying the balance remaining to be paid.

 

Discount vouchers can only be used once. If the face value of the Discount Voucher is higher than the face value of the ticket(s) chosen, the customer will not be able to claim a refund or the issue of a new Discount Voucher for the difference.

 

Discount Vouchers are valid on the purchase of products that are the subject of promotions.

 

Discount Vouchers cannot be exchanged or refunded (in whole or in part) even in the event of theft or loss.

 

The Discount Coupons are not nominative, their use is the exclusive responsibility of their holder.

 

Any attempt at fraud, such as forgery or concealment, which is intended to circumvent the present provisions will expose its author to a cancellation of the ticket(s) acquired, without prejudice to the implementation of other open legal remedies.

 

In general, customers are obliged to read and comply with the special conditions of use provided for on their discount voucher. In the event of any contradiction between these provisions and the latter, the special provisions shall prevail.

 

Art.6 - Fight against fraud

 

In order to fight against fraud, in particular by credit card, Last Ticket For You reserves the right to use the personal data of the customer to contact him, to ask him for the communication of his identity card and, if necessary, to cancel the ticket(s) ordered.

 

Art.7 - Processing of personal data

 

For detailed information on the collection, processing and transfer of personal data on the Site, Customers are invited to consult article 14.4 et seq. relating to the protection of personal data or/and by contacting the personal data protection officer (PDP) whose email address is pdp@lastticket.

 

7.1 Collection of personal data

 

When placing an order and/or creating an account, Last Ticket For You is led to collect from the customer certain information and data of a personal nature such as, but not limited to, first and last names, e-mail address, cell phone number.

 

7.2 Purposes of processing

 

The information and data concerning the customer are necessary for the reception of the newsletter, and/or for the management of the order and the commercial relationship. The information and data are also kept for security purposes and in order to comply with legal and regulatory obligations of data retention. Moreover, they allow Last Ticket For You to improve and personalize the services offered and the information addressed to the customer.

 

This data will be used within the framework of the treatment and the follow-up of the customer's order, as well as in the hypothesis of a possible postponement or cancellation of the corresponding event.

 

The customer accepts that the company Last Ticket For You, informed by the organizer of an event, of any decision affecting the conditions of the event (such as cancellation, postponement, modification of the place of organization), uses the contact information that he will have provided to Last Ticket For You within the framework of his order, in order to inform him of the said modifications, as well as the procedure to follow.

7.3 Recipients of the data

 

Within the framework of the processing and follow-up of the order, the companies with which Last Ticket For You is contractually bound and which have undertaken to ensure the strictest confidentiality (event organizers, technical service providers, etc.) may have access to this data. The authorities may also have access to your data if they request it.

 

7.4 Client's consent

 

The customer will be able, if he wishes, to authorize the company Last Ticket For You to send him its newsletters and to inform him of future Events organized by its partners, by SMS or e-mail.

 

The customer can also, if he wishes, receive by SMS or e-mail commercial proposals from partners to which Last Ticket For You is bound by contract (organizers, affiliated sites in particular). If he wishes to stop receiving information from Last Ticket For You and its partners at a later date, the customer will have to unsubscribe by means of the procedure following the obligatory communication.

 

7.5 Rights of opposition, access, correction

 

In accordance with applicable regulations, you have the right to access and rectify any information concerning you. You may also, for legitimate reasons, oppose the processing of data concerning you.

 

You can exercise these rights, whether they relate to the processing carried out by Last Ticket For You or by the organizing partners, by completing the form reserved for this purpose and contacting pdp@[#url#].

 

Art.8 - Validation of the order - Acceptance of the general conditions of sale

 

Before confirming his order, the customer declares to accept the present general terms of sale, fully and without reserve.

 

Except contrary proof, the data recorded by the company Last Ticket For You will represent the proof of the transactions passed on the Site, by the customer.

 

Art.9 - Delivery of tickets

 

9.1 Upon confirmation of the purchase, the customer will receive an order confirmation email as a purchase invoice.

 

9.2 The purchase confirmation e-mail contains a link to a ticket retrieval module. The tickets can be downloaded and will be sent automatically by e-mail.

 

9.3 By accepting these general terms and conditions of sale, the Customer also accepts the terms and conditions of use of e-tickets.

Art.10 - Ticket control

 

10.1 Ticket control

 

Ticket control will be carried out using barcode/QR Code readers by the Event organizer, under his responsibility, at the entrance to the said event. In the event that several purchases have been made via the web or by cell phone, each purchase will result in the creation of a ticket containing a digital code present on the ticket in the form of a barcode/QR Code and verified at the entrance to the place where the Event takes place.

 

 

 

10.2 Identity Control

 

The organizer reserves the right to check the identity of the client at the entrance of the place where the Event takes place. The client must therefore be in possession of an official, valid, photo ID: identity card, passport, driving licence or residence permit.

 

Art.11 - Uses and validity of tickets

 

11.1 Ticket Resale

 

Each ticket is nominative and personal and may only be resold in compliance with the Law on the Organization of Sports and Cultural Events, which prohibits, under penalty of criminal sanctions, the usual sale of tickets for cultural or sports events without the express authorization of the organizer or the owner of the exploitation rights.

 

11.2 Reproduction of tickets

 

It is strictly forbidden to reproduce, duplicate or counterfeit a ticket in any way whatsoever. The reproduction of bills is prohibited and would not provide any advantage.

 

The organizer may refuse access to the Event venue if it becomes aware that multiple prints or reproductions of a Barcode / QR code are in circulation and that access to the Event venue has already been granted.

 

11.3 Ticket Validity

 

The ticket is only valid for the event it relates to, at the date, time and under the conditions stated on the ticket. It must be retained until the end of the event.

Art.12 - Withdrawal, reimbursement and cancellation of tickets

 

12.1 Scope of application

 

These conditions of withdrawal, reimbursement and cancellation are applicable to all tickets sold on the Site.

 

12.2 Right of withdrawal

 

There is no right of retraction for tickets.

 

12.3 Refund and exchange

 

Once purchased by the customer, the ticket(s) cannot be exchanged or refunded (except in the cases of cancellation described in Article 12.4), even in the event that the ticket has not been used by the customer.

 

12.4 Cancellation or postponement of an event

 

In the event of definitive cancellation of an event, the reimbursement of the Ticket price will only be made in favor of the initial purchaser.

 

In addition, in order to be admissible, requests for reimbursement must be made within a maximum period of 2 months following the cancellation or postponement of the Event, unless a more restrictive condition is imposed by the organiser of the Event. Where applicable, Last Ticket For You will inform customers by e-mail.

 

Any request that does not comply with these conditions will be rejected.

 

It is also reminded that, in its capacity as commission agent, Last Ticket For You does not have free disposal of the funds it collects on behalf of the organizer and must submit to his instructions. Moreover, at the request of the Organizer, the transfer of the receipts can take place before the event is held. If this is the case, Last Ticket For You will proceed to reimburse the customers as soon as possible, it being understood that this cannot take place until the Organizer has paid the necessary funds to Last Ticket For You.

 

In the event of postponement of the event, the possible refund of the ticket or its exchange will be subject to the particular conditions of the organizer of the event. In any event, the exchange of the ticket will only be made in favour of the initial purchaser in exchange for the delivery of the ticket.

Art.13 - Liability

 

13.1 Responsibility of Last Ticket For You

 

The company Last Ticket For You is responsible, with regard to its customers, for the correct execution of the obligations resulting from the contracts concluded at a distance.

 

Last Ticket For You declines any responsibility in case of unavailability of the service resulting from a case of force majeure, in particular:

 

- Any abnormalities of the customer's computer equipment

 

- Unpredictable and insurmountable facts of a third party to the contract

 

- Unavailability of the internet network

 

13.2 Liability for lost or stolen tickets

 

Last Ticket For You is not responsible for any loss, theft or unlawful use of the Ticket.

 

Furthermore, it is specified that Last Ticket For You is not obliged to follow up on the request to issue a duplicate in case of loss or theft of the Ticket.

 

13.3 Responsibility for the conduct of the Event

 

Last Ticket For You is not responsible for the unfolding of the event (modification of the content, change of the artistic or sports distribution, change of the schedules...) or if necessary, its cancellation.

 

Likewise, Last Ticket For You declines all responsibility for damages suffered, by whatever cause, by the effects, objects, or materials brought by the spectators which are, if necessary, the responsibility of the organizer of the event.

 

13.4 Customer's liability during the event

 

Each organizer sets its own rules for the organization of the event. These rules are displayed on the organizer's site or at the entrance of the place where the event takes place or are communicated by the organizer to the client. The acquisition of a ticket implies adherence to the rules of procedure of the place of the event. The customer will strictly comply with the rules of the organizer under penalty of being held liable.

14.2 Litigation

 

The sales of tickets made on the website of the company Last Ticket For You are subject to Swiss law. Any litigation will be, in the absence of amicable agreement, of the exclusive competence of the Swiss courts.

 

Any litigation relating to the conclusion, the interpretation, the execution or the rupture of the contract concluded between Last Ticket and the customer, even in the event of recourse in guarantee or of plurality of defendants, will be, in the absence of amicable agreement, of the competence of the Swiss Courts.

 

CONDITIONS OF USE OF THE E-TICKET

 

The ticket is subject to the present general conditions of sale of Last Ticket For You as well as to the following special conditions, which all users accept before purchasing the ticket.

 

1.Control of the e-ticket

 

Entry to the event is subject to the validity check of your e-ticket.

 

We strongly advise you to arrive no later than 30 minutes before the start of the event.

 

During the checks, you must carry a valid, official, photo ID with you:

 

identity card, driving licence or residence permit. Family booklets are accepted for children.

 

For your safety, you may be required to submit to individual searches and bag checks.      

 

2.use of the e-ticket

 

The e-ticket is non-exchangeable and non-refundable, unless the Event is cancelled.

 

The e-ticket is personal.

 

The e-ticket is only valid for the Event, on the date and under the conditions indicated on the ticket. This title must be kept until the end of the Event.

 

In the event of failure to comply with all the rules specified above, this ticket will be considered invalid.

 3.3 Liability

 

Last Ticket For You declines any responsibility for anomalies that may occur during the ordering, processing or printing of the ticket insofar as it did not cause them intentionally.

 

Likewise, Last Ticket For You is not responsible in case of loss, theft or illicit use of the ticket.

Who is responsible for the processing?

 

All processing of personal data is carried out under the responsibility of the company Last Ticket For You.

 

What personal data is collected?

 

The data that we collect may include personal data that can identify you or make you identifiable (telephone number, e-mail, surname, first name, as well as your full postal address), as well as data collected for purely statistical purposes.

 

All the data that you agree to communicate directly to us are mandatory for the management of your order and are indicated by the presence of an asterisk in the purchase process or when creating an account. We may also ask you for your bank details (IBAN) to ensure the reimbursement of an event that would be cancelled.

What is personal data used for?

 

Managing your orders

 

The personal data collected and processed are primarily used for the management of your orders and the execution of the sales contract: ticket delivery, payment processing, invoicing, sending the order confirmation e-mail, export for access control at the entrance to the event, data transfer for the implementation of the contactless payment solution (if applicable), modification of the surname and first name of the ticket holder, management of the commercial relationship, after-sales service, cases of cancellation or postponement of an event, communication of information from the organizer about the event.

 

As the surname and first name of the ticket holder may relate to a person other than the purchaser, since we will be required to process this information for the purposes described in this document, we would be grateful if you could communicate it to the latter and request his or her prior consent.

 

Fight against fraud

 

We are committed to providing you and the organizers we work with with an impeccable quality of service. Thus, we may use the personal data we collect when you purchase a ticket(s) on our site to determine the risk of fraud associated with each order and to protect you against possible fraudulent use of your payment methods.

 

We may need to take additional measures to secure transactions, including requesting supporting documents containing personal data, if the results of monitoring and control operations so require.

 

Please note that your order will be suspended for the duration of the checks and that the order may be cancelled if the analysis carried out by our experts does not allow us to guarantee the reliability of the transaction. At the end of the checks, all the information you have communicated to our expert service will be systematically deleted.

 

The order may also be cancelled in case of fraudulent use of a means of payment, and your personal data will also be used to notify you.

 

In addition, in the event of a payment incident following a bank stop payment, you will be contacted by our services in order to regularize your situation, before cancelling your tickets, if necessary.

By using our website, the data that you communicate directly to us, that we collect through your navigation or purchases, or that results from deductions in comparison with other users, informs us about the content, genres, events, artists, venues, etc. that interest you or are likely to interest you and thus, to better understand and target your expectations.

The organizer

In accordance with our general terms and conditions of sale, the organizing partner will also be able to ensure your reimbursement beyond a period of two months, in the event of cancellation of an event.

 

The database to which the organizer has access for the purposes of the ticket sales contract clearly shows the purchasers who have consented to receive newsletters from them. You may therefore be contacted for this purpose if you chose this option when you created your customer account and may renounce to benefit from it at any time by making a request via the hypertext link included in each of these e-mails.

 

If Last Ticket For You is responsible for the collection and secure transfer of your data for these purposes, the processing described above is carried out by our organizing partner under its sole responsibility. In our capacity as intermediary, we undertake to oblige it to strict obligations of compliance with the applicable regulations and will ensure the centralization and transmission of your requests for the implementation of the rights you have.
